Terms and Conditions

These terms apply to the BookedOnMute website, demo process, and services unless a separate signed agreement says otherwise.

Effective date: July 20, 2026

1. Agreement and eligibility

By using the website, sending a form, requesting a demo, or using a BookedOnMute service, you agree to these Terms. If you act for a company or organization, you confirm that you have authority to bind it.

You must be at least 18 and legally able to enter a contract to purchase services. A minor may view public website content, but a binding order, subscription, or service agreement must be approved and entered by an authorized adult or legal entity.

2. Website information and proposals

Website content is general information. It is not a guarantee, service-level commitment, or binding offer. Features, integrations, launch timing, availability, and pricing are confirmed only in a written order form, statement of work, or other signed agreement.

Demos and sample conversations are examples. AI can misunderstand a caller, leave something out, or provide an inaccurate response. A live system needs client-approved instructions, testing, monitoring, and clear handoff rules.

3. Client responsibilities

  • Give us accurate business information, approved answers, policies, schedules, and escalation contacts.
  • Test the configured system before and after launch and report problems promptly.
  • Have the rights and permissions needed for the phone numbers, accounts, calendars, recordings, content, data, and integrations you provide.
  • Give legally required notices and obtain required consent for AI use, recording, transcription, calls, texts, and marketing.
  • Use the service lawfully and keep a reasonable human backup for urgent, sensitive, or complicated situations.

4. Uses that are not allowed

  • Illegal robocalling, spoofing, spam, harassment, deceptive impersonation, or contacting people without required consent.
  • Emergency dispatch, crisis response, replacing 911, or any use where a delay or error could cause immediate harm.
  • Medical, legal, financial, or other licensed advice without qualified human oversight and a separately approved workflow.
  • Collecting full card numbers, government identifiers, health information, children's information, or other sensitive data unless approved in writing with suitable safeguards.
  • Trying to bypass security, probe the service, introduce malware, scrape, reverse engineer where prohibited, or interfere with another user.
  • Using the system to discriminate unlawfully, commit fraud, mislead callers about identity, or violate another person's rights.

5. Permission to contact you

When you submit contact information and ask us to respond, you authorize BookedOnMute to contact you about that request by email, phone, or text. Message and data rates may apply. Marketing consent is not required to purchase. You can stop marketing texts by replying STOP and opt out of marketing emails through the unsubscribe method or by contacting us.

6. Third-party services

The service may rely on phone, AI, cloud, calendar, CRM, messaging, payment, and other third-party platforms. We do not control those providers and are not responsible for their outages, policy changes, content, security practices, or actions. Their terms and fees may apply.

7. Ownership and feedback

BookedOnMute and its licensors keep their rights in the website, brand, software, templates, workflows, documents, and other materials. Client content and third-party material remain excluded. After payment and subject to the signed agreement, a client receives only the rights expressly granted for the configured service.

You allow BookedOnMute to use the instructions, content, and data you provide as needed to perform the requested work. Feedback may be used without restriction or payment, but we will not identify you publicly without permission.

8. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." BOOKEDONMUTE DISCLAIMS IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR PRODUCE A PARTICULAR BUSINESS RESULT.

9. Limits on liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKEDONMUTE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES. BOOKEDONMUTE'S TOTAL LIABILITY ARISING FROM THE WEBSITE OR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID BOOKEDONMUTE DURING THE THREE MONTHS BEFORE THE EVENT THAT CAUSED THE CLAIM, OR $100 IF YOU PAID NOTHING.

Some places do not allow certain exclusions or limits, so part of this section may not apply to you.

10. Indemnification

To the extent the law allows, you agree to defend, indemnify, and hold BookedOnMute harmless from claims, losses, liabilities, and reasonable costs arising from your content, instructions, unlawful or unauthorized use, failure to obtain required consent, violation of these Terms, or violation of another person's rights.

11. Suspension and termination

We may restrict or suspend access when reasonably needed to address security, abuse, nonpayment, legal risk, third-party platform requirements, or a material violation. The signed agreement controls termination, data handling, refunds, and transition help.

12. Governing law and disputes

Pennsylvania law governs these Terms without regard to conflict-of-law rules. Before filing a claim, each party agrees to make a good-faith effort to resolve the issue informally. Unless the law requires otherwise, courts in Dauphin County, Pennsylvania, will have exclusive jurisdiction.

13. General terms and contact

If one part of these Terms cannot be enforced, the rest remains in effect. Not enforcing a provision once is not a waiver. We may post an updated version with a new effective date. Send questions to bookedonmute@gmail.com.
